PEI¼ø¼öÅõÀÚÀ̹ΠÀÚ°ÝÁ¶°Ç -PEI, PROVINCIAL NOMINEE PROGRAM, IMMIGRANT PARTNERS PROGRAM (PEI PNP IPP)

Disbursement of Funds:
  • Investment funds must be fully disbursed to the PEI Company before a Nomination Certificate (NC) can be issued;
  • MYIMIN commits that funds are not advanced from trust to the PEI Company until the PEI PNP office notifies MYIMIN that the NC is ready to be issued;


  • Redemption:
  • Government of Canada requires that the terms of the investment cannot include "a redemption option exercisable by the foreign national after a specified period" ? S. 87(6)(b) of IRPA.
  • In other words, the Immigrant cannot have a right that he/she can enforce in a Court of law for the return of the $200,000 in five (5) years time;
  • S. 87(6)(b) applies to all Provincial Nominee Programs in Canada;

    Director Liability:
  • May be elected for a period of 5 years and must be active with the Island owners;
  • All members of the Board of Directors have personal liability risk for (a) unpaid government tax remittances: PEI Provincial Sales Tax (PST), Federal Gov't Goods and Services Tax (GST), employee payroll remittances, and Workers Compensation premiums and (b) environment pollution liabilities;
  • MYIMIN addresses these issues by listing small and/or well managed PEI companies;

    PEI PNP IPP Investor Residency Policy
  • The PEI PNP IPP investor immigrant must establish a residence in the Province of PEI and be able to show that he/she has done so for a period of one year from the time he/she arrives in PEI after landing.

    Refund of the Good Faith Deposit
  • Conditions for Refund of $25,000:
    • The Immigrant is active in the investee company as a Director;
    • The Immigrant has maintained a residence in PEI for a minimum period of one (1) year after landing;
  • Documents needed for Refunds:
    • A declaration from Investee company about the Immigrant being active as a Director:
    • Receipts to show that a dwelling was leased/owned and occupied by the Applicant's family as well as any evidence of local employment by family members, utility bills; registration of any children at a local school or daycare facility, or community or other third party corroboration;


    Charter of Rights to Mobility
  • The immigrant, as a Permanent Resident of Canada, has the right
    1. to move to and take up residence in any province; and
    2. to pursue the gaining of a livelihood in any province.

  • Role of the Director:
  • The Board of Directors makes decisions for the company -- for example, to buy or sell major assets, to borrow or pay a large amount of money, to declare dividends, to approve share transfers, or to elect Officers (President, Secretary, Treasurer);
  • One vote per Director ? majority rules;
  • Board meetings are "called" with "notice" of the "purpose of the meeting";
  • PEI PNP requires that the Immigrant, as a Director, may not delegate the responsibility to act as Director to another by "proxy" or to a substitute;

    Three (3) Business Day Visit to PEI:
  • Required by PEI PNP during which time the Immigrant is to perform his/her due diligence.
  • The Interview is,
    • either Tuesday or Wednesday
    • conducted by a PEI PNP Processing Officer
    • informal, usually oral only
    • closed to all but immediate family
    • lasts about thirty (30) to sixty (60) minutes.
  • The Interviewer speaks slowly;
  • The result is usually provided at the end of the Interview;

    PEI PNP PROCESSING:
  • For fast PEI PNP processing, the Immigrant and his/her Professional Immigration Consultant should provide "complete" documents with the Application and "complete, clear and speedy" responses to the Errors/Omission Notice;
  • The PEI PNP IPP targets 15 business day response times on Document filings;
  • Well prepared files are receiving Nomination Certificates within 100 business days;
  • PEI PNP IPI processing time can be very fast;
